These Terms of Service (“Terms”) govern your access to and use of the website located at www.savepods.com (the “Site”), including any purchases of products or services offered through the Site.

The Site is operated by Savepods Inc. (“Savepod,” “we,” “us,” or “our”).

By visiting the Site, purchasing a product from us, creating an account, or otherwise using our services, you agree to be bound by these Terms and our other policies incorporated by reference, including our Privacy Policy and Return, Refund & Limited Warranty Policy.

If you do not agree to these Terms, you should not use the Site or purchase products through it.

 

1. Eligibility and Use of the Site

You must be at least 13 years old to use this Site.

If you are under the age of majority in your jurisdiction, you may use the Site only with the involvement and permission of a parent or legal guardian.

You must be legally capable of entering into a binding contract to make a purchase from us.

You agree not to use the Site or our products for any unlawful or unauthorized purpose or in violation of any applicable law.

 

2. Product Purchases

Products offered on the Site are subject to availability.

We reserve the right to:

  • Limit the quantities of products available for purchase;

  • Refuse or cancel orders where reasonably necessary;

  • Discontinue products;

  • Modify product designs or specifications;

  • Correct pricing, description, inventory, or other errors;

  • Limit sales to particular persons, geographic regions, or jurisdictions.

If we cancel an order after payment has been processed, we will refund the amount charged for the canceled portion of the order.

 

3. Pricing

Prices displayed on the Site are shown in the applicable currency and may change without notice.

Taxes, shipping costs, duties, and other applicable charges may be added during checkout.

Although we make reasonable efforts to ensure pricing information is accurate, errors may occur. If an obvious pricing error affects an order, we may cancel the order and refund the amount paid.

Promotions, discounts, coupon codes, bundles, and other offers may be subject to additional terms and may be changed or discontinued at any time to the extent permitted by law.

 

4. Payment

Payments may be processed through Shopify or third-party payment providers.

By providing payment information, you represent that you are authorized to use the payment method provided and authorize us and our payment providers to charge the applicable amounts.

Payment processing may also be subject to the terms and privacy practices of the applicable payment provider.

 

5. Shipping and Delivery

Shipping estimates are estimates and are not guaranteed delivery dates unless expressly stated otherwise.

We are not responsible for delays caused by circumstances outside our reasonable control, including carrier delays, weather, customs processing, transportation interruptions, incorrect customer-provided addresses, or other events beyond our control, except where applicable law provides otherwise.

Customers are responsible for providing complete and accurate shipping information.

If an order is returned or cannot be delivered because the customer provided an incorrect or incomplete address, additional shipping charges may apply before the order is resent.

Nothing in this section limits rights provided to consumers by applicable law.

 

6. Returns and Refunds

Savepod currently offers eligible customers a 14-day return period beginning on the date the product is delivered.

Returns are governed by our separate Return, Refund & Limited Warranty Policy, which is incorporated into these Terms by reference.

Customers are responsible for return shipping unless otherwise stated by Savepod or required by applicable law.

Products purchased through third-party marketplaces, including Amazon, may also be subject to the marketplace's applicable return procedures.

 

7. One-Year Limited Product Warranty

Certain Savepod products are covered by a One-Year Limited Warranty, as described in our Return, Refund & Limited Warranty Policy.

The warranty is separate from the 14-day return period.

The availability of a warranty does not extend the 14-day voluntary return period.

Nothing in these Terms is intended to exclude or limit any warranty or consumer protection rights that cannot legally be excluded or limited.

 

8. Product Compatibility

Savepod products are designed for use with certain single-serve coffee brewing systems.

Savepod products are generally compatible with many brewers designed to accept K-Cup®-compatible pods, but compatibility varies by brewer model and product configuration.

Customers should review our current compatibility information at:

www.savepods.com/pages/compatibility

before purchasing or using a Savepod product.

Compatibility information may be updated as new brewers, models, or product configurations are introduced.

If you are uncertain whether your brewer is compatible, contact us at hey@savepods.com before purchasing.

 

9. Known Compatibility Limitations

Savepod products are not universally compatible with every single-serve coffee brewer.

At the time these Terms were last updated, known incompatible systems or configurations include:

  • Keurig® K-Mini Mate

  • Keurig® K-Mini Mate Plus

  • Keurig® K-Crema

  • Nespresso® machines

  • Certain Ninja® brewers using a three-prong piercing configuration

Savepod is compatible with certain Ninja® brewers using a one-prong configuration.

Because manufacturers may introduce new models or modify existing products, customers should rely on our current Compatibility page for the most up-to-date compatibility information.

 

10. Brewing Results and User Variables

Coffee preparation involves a number of variables.

Results may differ based on factors including:

  • Brewer make and model;

  • Coffee grind size;

  • Coffee type;

  • Roast;

  • Amount of coffee used;

  • How the product is filled;

  • Brew size;

  • Water flow;

  • Machine condition and maintenance;

  • Filter selection;

  • Product configuration; and

  • User technique.

Accordingly, we do not guarantee that every combination of coffee, brewer, grind, fill amount, brew setting, or technique will produce identical results.

Customers should follow the instructions supplied with the applicable Savepod product.

11. Product Safety

Savepod products should be used only for their intended purposes and according to the instructions provided.

Some Savepod products may contain small components that could present a choking or other safety hazard to young children.

Keep small components away from children and pets.

Children should not assemble, disassemble, or use Savepod products without appropriate adult supervision.

Coffee brewers may contain hot water, hot surfaces, piercing needles, and other components capable of causing injury. Use appropriate care when installing, removing, filling, cleaning, or otherwise handling Savepod products.

Do not attempt to reach into or manipulate a brewer's piercing mechanism while the brewer is operating or while it may be hot.

 

12. Proper Use

You agree to use Savepod products only as reasonably intended.

Improper use may include, without limitation:

  • Using a product with an incompatible brewer;

  • Improper assembly;

  • Installing components incorrectly;

  • Modification of the product;

  • Forcing components into a brewer;

  • Using damaged components;

  • Using the product contrary to provided instructions; or

  • Using the product for purposes for which it was not designed.

Savepod is not responsible for damage resulting solely from misuse, unauthorized modification, or use contrary to the supplied instructions, except to the extent responsibility cannot legally be excluded.

 

13. Product Information

We make reasonable efforts to ensure that product descriptions, photographs, specifications, compatibility information, and other content on our Site are accurate.

However, product appearance, packaging, materials, features, or specifications may occasionally change.

Colors and appearance may also vary depending on displays, photography, lighting, and manufacturing variations.

We reserve the right to correct errors or omissions and update information where appropriate.

 

14. Intellectual Property

The Site and its contents, including without limitation:

  • Savepod® trademarks;

  • Logos;

  • Product names;

  • Product designs;

  • Patented technology;

  • Photographs;

  • Videos;

  • Illustrations;

  • Graphics;

  • Written content;

  • Packaging;

  • Marketing materials; and

  • Website content

are owned by or licensed to Savepods Inc. and are protected by applicable intellectual property laws.

Nothing on the Site grants you any license or right to use Savepod intellectual property except for your personal, non-commercial use of the Site and products as intended.

You may not reproduce, copy, modify, distribute, sell, reverse engineer, create derivative commercial products from, or otherwise exploit our protected intellectual property except where expressly authorized by Savepods Inc. or permitted by law.

 

15. Third-Party Trademarks

The Site may reference trademarks or products belonging to third parties for purposes such as identifying product compatibility.

Such references do not imply sponsorship, endorsement, affiliation, or association.

16. Reviews, Feedback, and User Submissions

If you voluntarily submit reviews, testimonials, photographs, videos, comments, suggestions, ideas, feedback, or other content to us, you represent that you have the right to submit that content.

Unless otherwise agreed in writing, you grant Savepods Inc. a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to use, reproduce, display, distribute, adapt, and publish that content in connection with our business, products, marketing, and Services, subject to applicable law.

You retain ownership of your original content.

This provision does not apply to private customer-service communications that are not submitted or intended as reviews, testimonials, promotional content, or public feedback.

17. Prohibited Uses

You may not use the Site:

  • For unlawful purposes;

  • To violate intellectual property rights;

  • To transmit malware or harmful code;

  • To interfere with the security or operation of the Site;

  • To scrape or systematically collect Site content without authorization;

  • To impersonate another person;

  • To commit fraud;

  • To provide false purchasing information;

  • To abuse promotions or refund procedures; or

  • For any other activity that materially interferes with our business or other users.

We may suspend or restrict access to the Site where reasonably necessary to protect the Site, our customers, or our business.

 

18. Third-Party Services and Links

Our Site may contain links to or integrations with services operated by third parties.

We are not responsible for the content, availability, security, privacy practices, or policies of third-party websites or services.

Your interactions with those third parties may be governed by their own terms and policies.

 

19. Disclaimer of Warranties

EXCEPT FOR ANY EXPRESS WRITTEN WARRANTY PROVIDED BY SAVEPOD AND EXCEPT TO THE EXTENT PROHIBITED BY APPLICABLE LAW, THE SITE AND SERVICES ARE PROVIDED ON AN “AS AVAILABLE” BASIS.

WE DO NOT GUARANTEE THAT THE SITE WILL ALWAYS BE AVAILABLE, ERROR-FREE, OR UNINTERRUPTED.

NOTHING IN THESE TERMS DISCLAIMS, EXCLUDES, OR LIMITS IMPLIED WARRANTIES OR OTHER CONSUMER RIGHTS TO THE EXTENT SUCH RIGHTS CANNOT LAWFULLY BE DISCLAIMED, EXCLUDED, OR LIMITED.

 

20. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SAVEPODS INC. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR RELATING TO THE SITE, SERVICES, OR PRODUCTS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SAVEPODS INC.'S TOTAL LIABILITY ARISING FROM A PARTICULAR PRODUCT PURCHASE WILL NOT EXCEED THE AMOUNT PAID TO SAVEPODS INC. FOR THE PRODUCT GIVING RISE TO THE CLAIM.

THESE LIMITATIONS DO NOT APPLY TO LIABILITY THAT CANNOT LAWFULLY BE LIMITED OR EXCLUDED, INCLUDING LIABILITY TO THE EXTENT ARISING FROM RIGHTS OR REMEDIES THAT APPLICABLE CONSUMER LAW MAKES NON-WAIVABLE.

Some jurisdictions do not permit certain exclusions or limitations, so portions of this section may not apply to you.

 

21. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Savepods Inc. and its officers, directors, employees, and agents from claims, damages, liabilities, and reasonable costs arising from your unlawful use of the Site, intentional misuse of our products, infringement of third-party rights, or material violation of these Terms.

This provision does not require a consumer to indemnify Savepods Inc. for Savepods Inc.'s own negligence, defective products, unlawful conduct, or other liability that cannot lawfully be shifted to the consumer.

 

22. Informal Resolution of Disputes

Before filing a lawsuit relating to these Terms or a purchase from Savepods Inc., we encourage you to contact us at:

and provide a reasonable description of the dispute.

We will make a good-faith effort to resolve disputes directly where practical.

Nothing in this section prevents either party from exercising rights or remedies that cannot legally be waived.

 

23. Governing Law

To the extent permitted by applicable law, these Terms and disputes arising from them are governed by the laws of the State of Delaware, without regard to conflict-of-laws principles.

Mandatory consumer-protection laws of your state or jurisdiction may continue to apply notwithstanding this provision.

 

24. Venue

To the extent permitted by applicable law, any legal proceeding arising out of these Terms that is not otherwise required to be brought in another jurisdiction shall be brought in an appropriate state or federal court having jurisdiction over Savepods Inc.

Nothing in this provision prevents a consumer from bringing a claim in small-claims court or another forum where applicable law provides a non-waivable right to do so.

 

25. Severability

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed where necessary.

The remaining provisions will remain in effect.

 

26. No Waiver

Our failure to enforce a provision of these Terms does not constitute a waiver of that provision or any other rights.

 

27. Entire Agreement

These Terms, together with our Privacy Policy, Return, Refund & Limited Warranty Policy, Trademark & Compatibility Disclaimer, and any other policies expressly incorporated by reference, constitute the agreement between you and Savepods Inc. concerning your use of the Site and purchases made through it.

 

28. Changes to These Terms

We may update these Terms from time to time.

Changes will be posted on this page with an updated “Last Updated” date.

Changes will apply prospectively except where applicable law permits otherwise.
